The terms “we”, “us” and “our” refer to ANAM. ANAM operates this store and website, including all related information, content, features, tools, products and services, to provide you with a curated shopping experience (the “Services”). Our store is powered by Shopify. These terms, together with the policies referred to in them, are our Terms of Service (the “Terms”) and describe your rights and responsibilities when you use the Services.

By visiting or using the Services, you agree to these Terms and our Privacy Policy. If you do not agree, please do not use the Services.

1. Access and account

By agreeing to these Terms, you confirm that you are at least 18 years old, or that you are using the Services with the consent of a parent or guardian. You agree that the information you give us, including your email, billing, payment and shipping details, is correct, current and complete. You are responsible for keeping your account login details secure and for all activity on your account, and you may not transfer your account to anyone else.

2. Our products

We make every effort to show our products accurately, but colours and appearance may vary depending on your screen and device settings. Product descriptions may change without notice. We may discontinue any product at any time and may limit the quantities we sell to any person or region.

3. Orders

When you place an order, you are making an offer to buy. We may accept or decline an order at our discretion, and an order is only accepted once we confirm it and receive payment. Please check your order carefully before submitting it. If we decline, change or cancel an order, we will let you know using the contact details you gave at checkout, and refund any payment received for it. Returns and exchanges are handled under our Return and Refund Policy. Purchases are for personal or household use, not for commercial resale.

4. Prices and billing

All prices are in South African Rand (ZAR) and include VAT where applicable. Shipping costs are calculated and clearly displayed at checkout before payment is completed. Prices, discounts and promotions may change without notice, but the price you pay is the price shown when you place your order, as confirmed in your order confirmation email. You confirm that you are authorised to use the payment method you provide.

Delivery time. Orders are estimated to arrive within 5–11 working days. Delivery times are estimates and may vary depending on your location, courier operations, public holidays, peak shopping periods, or unforeseen delays. Full details are on our Shipping & Delivery page.

Order processing and tracking. Once your order has been processed and dispatched, you will receive tracking information where available.

Delivery delays. While we do our best to ensure orders are delivered within the estimated timeframe, ANAM cannot be held responsible for delays caused by third-party courier services or circumstances outside of our control.

Risk in the goods passes to you on delivery. If you have any questions regarding your order or delivery, please contact us using the details in section 20.

6. Intellectual property

The content of our Services, including text, images, graphics, product reviews, video and the design and arrangement of these materials, belongs to ANAM or its licensors and is protected by intellectual property law. You may use the Services for personal, non-commercial purposes only, and may not copy, reproduce or republish any part of them without our written permission. ANAM’s name and logo are trademarks of ANAM. Shopify’s name and logo are trademarks of Shopify. All other trademarks shown on the Services belong to their respective owners.

7. Relationship with Shopify

Our store is powered by Shopify, but any purchase you make in our store is made directly with ANAM. Shopify is not responsible for any part of the sale between you and ANAM.

8. Privacy

Personal information we collect through the Services is handled under our Privacy Policy, and may also be subject to Shopify’s Privacy Policy. Because our store is hosted by Shopify, information you submit may be processed by Shopify and its partners, including outside South Africa.

9. Errors, inaccuracies and omissions

Occasionally our Services may contain errors in product descriptions, pricing, promotions, shipping charges, delivery times or availability. We may correct such errors and update information at any time. If an error affects an order you have placed, we will contact you before processing it, and you may cancel the order for a full refund.

10. Termination

We may suspend or end your access to the Services if you breach these Terms. Sections that by their nature should continue, such as intellectual property, limitation of liability and governing law, remain in effect after termination.

11. Disclaimer of warranties

To the extent permitted by law, the Services and the information on them are provided “as is” and “as available”. We do not guarantee that the Services will be uninterrupted, secure or error-free. This does not affect the quality and safety guarantees that apply to the products you buy under the Consumer Protection Act.

12. Limitation of liability

To the extent permitted by law, ANAM is not liable for indirect or consequential loss arising from your use of the Services or our products, and our total liability for any order is limited to the amount you paid for that order. Nothing in these Terms excludes liability that cannot be excluded by law.

13. Your statutory rights

Nothing in these Terms limits or excludes your rights under South African law, including the Consumer Protection Act, 2008 and the Electronic Communications and Transactions Act, 2002. Where these Terms conflict with those rights, your statutory rights apply.

14. Severability

If any part of these Terms is found to be unlawful or unenforceable, it will be enforced to the fullest extent allowed by law, and the rest of these Terms will remain in effect.

15. Waiver and entire agreement

If we do not enforce any right under these Terms, that is not a waiver of the right. These Terms and the policies posted on our website are the entire agreement between you and us about the Services.

16. Assignment

You may not transfer your rights or obligations under these Terms without our written consent. We may transfer ours, for example if our business is sold.

17. Governing law

These Terms are governed by the laws of the Republic of South Africa.

Headings are for convenience only and do not affect the meaning of these Terms.

19. Changes to these Terms

We may update these Terms from time to time by posting the new version on this page. The version in effect when you place an order applies to that order.
